Welcome to Jibuy! These Terms and Conditions govern your use of our online marketplace, whether as a vendor (seller) or a client (buyer). By accessing or using Jibuy, you agree to comply with these terms in accordance with the Kenya Information and Communications Act (KICA), the Data Protection Act (2019), the Consumer Protection Act (2012), and other relevant Kenyan laws.
"Jibuy" refers to the eCommerce platform available at [insert domain name].
"Vendor" means an individual or business that sells goods or services via Jibuy.
"Client" means a person who purchases goods or services through Jibuy.
"User" refers to any registered user of the platform, either Vendor or Client.
All users must create an account with accurate and complete details.
Users must be at least 18 years old or have legal guardian approval.
You are responsible for all activity under your account and for safeguarding your password.
Jibuy may verify information before approving vendors.
Provide accurate delivery and contact information.
Review product information and terms before making purchases.
Use Jibuy responsibly and in compliance with the law.
Ensure all listings are truthful, legal, and clearly priced in Kenyan Shillings (KES).
Fulfill orders within the promised timeframe.
Comply with Kenyan laws on trade, taxation, and consumer rights.
Avoid selling counterfeit, illegal, or banned items as outlined by the Kenya Revenue Authority (KRA) and KEBS.
Payments are made through Jibuy’s secure payment gateways.
Clients will see all applicable charges (e.g. price, VAT, delivery).
Jibuy charges a transaction commission from vendors, details of which are available in the Vendor Portal.
Refunds, where applicable, will be processed through the same payment method.
Vendors are solely responsible for dispatching orders within agreed delivery periods.
Clients will receive shipping updates and expected delivery timelines.
Delays must be communicated promptly through the Jibuy platform.
Clients can initiate returns for damaged, defective, or incorrect items within 7 days of delivery.
Vendors must honor valid return requests in accordance with the Consumer Protection Act, 2012.
Disputes should first be addressed via Jibuy's resolution center. If unresolved, Jibuy will mediate and make a final determination.
You agree NOT to:
Post false, misleading, or offensive content.
Sell counterfeit or restricted goods under Kenyan law.
Attempt to bypass the Jibuy platform to complete transactions.
Use the platform for illegal or harmful activities.
All content, logos, designs, and trademarks on Jibuy are the property of Jibuy or its licensors.
Vendors retain ownership of their listings but grant Jibuy permission to use their content for marketing and operational purposes.
Jibuy is compliant with Kenya’s Data Protection Act (2019).
Personal information is collected, stored, and processed solely for platform use, security, communication, and legal obligations.
We do not sell or misuse user data.
Jibuy is a marketplace and is not liable for defective or delayed goods.
We are not responsible for losses caused by third-party vendors or external events.
Our total liability shall not exceed the amount paid by the client or payable to a vendor in the specific transaction.
Jibuy reserves the right to suspend or terminate accounts violating these terms or the law.
Users may delete their accounts at any time.
These Terms may be updated periodically. Continued use of the platform after updates constitutes acceptance of the new terms.
Users are encouraged to review terms regularly.
These Terms are governed by the laws of the Republic of Kenya. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts in Nairobi, Kenya.
